Terms and conditions for the purchase of promotional gifts

  • Galpeg transacts business upon and subject to these terms and conditions and will be deemed to be incorporated into all contracts between Galpeg and the Buyer to the exclusion of any other terms and conditions of the Buyer.
  • An estimate shall only constitute an invitation to treat. All orders are subject to acceptance by Galpeg, the Buyer acceptance of delivery of said acknowledgement of orders shall be deemed to include acceptance of these terms and conditions.
  • Galpeg cannot guarantee that the goods will be exactly the same as previously supplied. Samples are available on request to check for size, materials etc.

Quoted prices are those ruling at the date of a quotation and will be held firm for a period of 21 days unless otherwise stated within the quotation.

Pricing: Where applicable all prices are subject to VAT at the current rate. Prices quoted on this website are a guide only and are subject to viewing final artwork. A quotation price will be provided once artwork and full specifications have been confirmed.

Delivery: Galpeg will make every effort to meet the delivery date requested by the Buyer. Where a delay in delivery occurs through no fault of Galpeg giving rise to an increase in Galpeg’s cost, the Buyer shall reimburse Galpeg.  Galpeg will not be liable for any losses incurred by the Buyer in the event of a delay in delivery unless Galpeg has expressly agreed in writing beforehand to meet the delivery date requested by the Buyer. Each delivery will be considered a separate transaction and the failure of any one delivery shall not affect the due performance of any other contracts.

Payment: Account holders are to pay within 30 days from the invoice date.  All non-account holders are to pay on a proforma basis.  All new accounts will pay their first invoice by proforma.

Waiver: Failure by Galpeg at any time to enforce any of the provisions of these general conditions shall not be construed as waiver by Galpeg of such provisions or in any way affect the validity of these terms and conditions. All prices shall be as per Galpeg’s price list current at the date of despatch.

Passing of Title and Risk: The risk in the goods shall pass to the Buyer on delivery. All goods delivered or not, remain the property of Galpeg until payment is received in full.

Over and Under Quantities: Printed goods may be subject to a maximum 5% over or under run. Galpeg reserves the right to invoice and deliver the actual quantity produced.  Confirmation of the absolute minimum quantity that Galpeg must supply to the Buyer must be communicated to Galpeg in writing at the time of placing the order.  Galpeg will then ensure that the minimum quantity will be supplied to Buyer.

Carriage: All prices are exclusive of carriage costs. Galpeg will provide a quotation for carriage where possible in advance or provide an estimate.

Samples: Samples are for sale only and are non-returnable / refundable.

Goods: Galpeg warrants that the goods correspond with the description and sample and are of merchantable quality and where Galpeg represents in writing that the goods are fit for a particular purpose, Galpeg warrants that the goods are fit for the said purpose. Galpeg reserves the right to alter any details or design of goods illustrated without prior notice and while every effort is be made to describe goods accurately on this website no warranty is given as to the accuracy and no responsibility will be accepted for any error or incorrect description and any resulting loss.

Claims: Claims arising from damages, delay or partial loss in transit must be made in writing to Galpeg, so as to reach Galpeg within 7 days of receipt of the goods. All claims with regard to the quality or quantity of the goods shall be made in writing to Galpeg, so as to reach Galpeg within three days of receipt of the goods. In the case of non-delivery of the whole consignment, the Buyer must submit a claim to Galpeg in writing within 14 days of notification of despatch of the goods to the Buyer. Galpeg’s liability for breach of the aforesaid warranty shall be limited to ...

  • replacing the defective goods
  • making good the defect
  • allowing full credit for the cost of the defective goods by Galpeg

Galpeg shall not be liable for consequential loss rising out of a breach of the aforesaid warranty.

Cancellations: All cancellations must be made in writing and are subject to any costs incurred until the date of cancellation. Cancelled orders are subject to an additional £80 cancellation fee for orders valued below £500. All orders above £500 are subject to a 15% cancellation fee.

Force Majeure: Galpeg will not be held responsible for failure or delay in the carrying out of Galpeg’s obligations under the contract arising out of any cause outside Galpeg’s reasonable control or inability to procure materials or articles except at higher prices due to any such cause and in any circumstances Galpeg shall be entitled by notice to terminate the contract in whole or in part without incurring any liability whatsoever to the Buyer.
